Terms and Conditions for Hy-Farm Microgreens Shop

1. Object of the conditions 

1.1. The goods covered by this contract represent the MATERIALS NECESSARY FOR MICROGREENS PRODUCTION, and these will be delivered by the SELLER to the BUYER.

2. Delivery conditions 

2.1. Goods are delivered with external transport partners.

2.2. Goods will be delivered between Monday and Thursday, subject to stock availability.

3. Seller’s obligations 

3.1. To inform the BUYER as soon as possible after receiving the order about the availability of the requested goods, if applicable.

3.2. To provide, upon request, the Microbiological Analysis and the Quality Certificate for each variety and batch received from their suppliers.

3.3. To provide the storage and handling data sheet for the products.

3.4. To cancel the BUYER’s invoice if the goods are refused for the following reasons: goods damaged during transport or goods damaged due to packaging. This will be done based on a report prepared by the courier company together with the recipient (BUYER).

3.5. To replace the seeds if it is found, after an investigation, that they left the seller to the buyer non-compliant.

3.6. The seller is not responsible for delays in parcels after they are picked up by the courier.

4. Buyer’s obligations 

4.1. To place the order through our online platform.

4.2. Any order placed on Fridays, Saturdays, and Sundays will be processed on Monday.

4.3. To pay the SELLER the value of the goods, according to the invoice sent electronically.

4.4. To ensure the storage and handling of the products under the conditions specified in the technical specification received from the SELLER.

4.5. To assume the quantity and variety of products ordered through the online platform. Once the goods are paid for, no changes can be made to the ordered goods.

4.6. To pay the cost of transport both ways if the BUYER refuses the goods for reasons not listed in section 3.6.

4.7. To pay the difference in transport costs billed by the courier company to the SELLER in case there are changes to the delivery location or delivery day.

5. Disputes 

5.1. Any disputes arising from these terms and conditions will be resolved amicably. If this is not possible, the dispute will be submitted to arbitration by the Chamber of Commerce and Industry of Romania or will be resolved according to common law norms.

6. GDPR and Privacy Policy 

6.1. We collect and process your personal data to complete the order and deliver the products. The processed data includes your name, address, phone number, and email address.

6.2. Personal data is collected, stored, and processed in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR).

6.3. Personal data will not be shared with third parties except where necessary to complete the order (e.g., the courier company).
